EU refused Germany’s request for keeping 3 heavy metals (As, Sb & Hg) requirements in EN71-3
In 2009 the European Union released a new Toy Directive 2009/48/EC. Apart other requirements, new limits for the migration of metals were introduced. Germany requests to keep its old limits for the migration of Arsenic, Antimony, Mercury, Lead and Barium.
On 14 May 2014, The General Court confirms the Commission’s decision according to which Germany may not maintain its current limit values for Arsenic, Antimony and Mercury.
In regards to Lead, the Commission allowed Germany to keep its Lead limit but this is not a sufficient reason for rejecting the German limit request.
Problems in regards to the limits for Barium are solved. Germany declared that meanwhile this case is solved as the EU Commission already revised the limits for Barium (by 2013/681/EC). So Germany will follow the limits for Barium according to the EU requirements.
The German government can appeal to the EU General Court due to different views.
