EU published a Proposal amending Regulation (EU) 2023/1542 on battery due diligence policies implementation date postponed to 2027

On 21 May 2025, European Commission published a Proposal COM (2025) 258 final, for amending Regulation (EU) 2023/1542 on battery due diligence policies implementation date. The due diligence obligations of the European Union Battery Regulation (EU) 2023/1542 should be postponed by two years. Based on the original text of the policy, LEO-MTS Lab has extracted the key information for you as follows:

2.Reason for the extension

-There is a shortage of third-party notified bodies. Half of the EU member states have not yet designated their notifying authority body.
-Lack harmonized recognition standard (e.g. critical minerals such as cobalt, natural graphite, lithium and nickel). Due diligence schemes for battery raw materials are still under development, and no schemes have been approved by the European Union.
-Regulatory coordination needs Alignment with the Corporate Sustainability Due Diligence Directive (EU) 2024/1760) is required to avoid.
