Lead Requirement in Jewelry of the New York State

The Bill (A08978) was announced on January 7, 2020 on the website of New York State Assembly, and will take effect from January 1, 2021. Pursuant to the proposals of legislative bills numbers S.4046 and A.6041, the Bill (A08978) amends both Section 37-0115 and Section 71-3705 of the environmental conservation law.

1.The changes of Section 37-0115. Lead-Containing Jewelry of the environmental conservation law include:
  A.The total lead content between 0.004% (40 parts per million) and 0.01% (100 parts per million) by total weight in any component part of children’s jewelry should not be put into the market, unless the jewelry bears a warning statement indicating that at least one component part of the item contains lead.
  B.The warning sentence “COMPLIES WITH FEDERAL STANDRADS” has been omitted from the warning statement for children’s jewelry.

2. The whole Paragraph 2 about how to access the penalty has been deleted from the Section 71-3705. Enforcement of Section 37-0115 of the environmental conservation law.
