On the Application of Directive 2009/48/EC on the Safety of Toys Musical Instrument

On February 26, 2019, the European Commission published “Guidance Document No10 on the Application of Directive 2009/48/EC on the Safety of Toys Musical Instrument”, due to the classification difficulty of some borderline musical instruments. This guidance document is not a binding document, but to provide more guidelines to differentiate toy musical instruments from real musical instruments for children, besides the Guidance document No 4 and No. 11. It suggests that the classification of the musical instrument may be considered from the following aspects: the purpose of the product, the characteristics of the product, the documents accompanying the product, the place of sale, the public at which the product is aimed and the retail price. Most importantly, the reasonably foreseeable use is considered to prevail over the declaration of intended use by the manufacturer. Along with the illustration of the musical instruments to be considered as toys and the real musical instruments for children, the Maracas is selected as a particular case of the borderline musical instrument for expounding.
